Terms and conditions

01Scope

These terms and conditions apply to direct bookings for the temporary provision of the Anno 1860 holiday apartment for accommodation purposes. The landlord is Guido Schmitz, Neustraße 17, 53547 Dattenberg, Germany. Individual arrangements set out in the booking confirmation take precedence over these terms.

02Booking request and formation of the contract

The presentation of the apartment on this website is for information only and does not constitute a binding offer. Information and preliminary discussions by telephone are non-binding. A booking request must be submitted by email and should state the requested travel dates, number of guests, guest's full name, address and telephone number. The minimum stay is two nights. These terms and conditions and the house rules are provided before the contract is concluded and become part of the booking agreement only with the guest's consent. After the request has been reviewed, the apartment will be reserved on a non-binding basis for seven calendar days and the guest will receive the payment information. The accommodation contract is concluded only when the full invoice amount has been received within that period. The guest will then receive the final booking confirmation. If payment is not received on time, the reservation ends without a contract being concluded and the apartment may be released again.

03Prices and payment

The prices and services stated in the reservation and payment information and subsequently in the booking confirmation apply. Final cleaning is included in the accommodation price; no security deposit is charged. The full invoice amount must be paid by bank transfer within the seven-day reservation period. Bank details are provided by email together with the reservation and payment information. Prices for chargeable extras are available on request and are charged only if expressly agreed or used during the stay.

04Arrival, departure and handover of keys

Arrival is scheduled between 4:00 and 8:00 pm and departure between 8:00 and 10:00 am. Different times require prior agreement. Keys are handed over in person. Late arrival or early departure does not entitle the guest to a proportionate refund unless the landlord is responsible for the circumstances.

05Cancellation by the guest

A cancellation must be made in text form, in particular by email. The accommodation price is the total price for the booked nights, including final cleaning, stated in the booking confirmation, but excluding separately agreed extras. Cancellation is free of charge up to 30 days before arrival. For cancellations 29 to 14 days before arrival, 50% of the accommodation price will be charged; 13 to 1 day before arrival, 80%; and on the day of arrival or in the event of a no-show, 90%. If the cancelled period can be re-let, only the loss actually incurred will be charged. The guest remains entitled to demonstrate that no loss, or a substantially lower loss, was incurred.

06Occupancy and use

The apartment is available exclusively to adults and may be occupied only by the agreed number of guests. Transfer to third parties, subletting or use for purposes other than accommodation is not permitted without prior consent. Pets are not permitted. The apartment is arranged over two floors and is not accessible.

07Duty of care and house rules

The guest must treat the apartment, its furnishings and shared areas with care and report any damage or disruption without delay. The house rules provided before the contract is concluded form part of the booking agreement. The guest is liable in accordance with the statutory provisions for damage culpably caused by the guest or accompanying travellers.

08Additional services

Additional services such as the sauna, garage, EV charging point or selected drinks form part of the booking only if expressly agreed. Use of the washing machine and tumble dryer in the adjoining room is by prior arrangement. The prices communicated when chargeable extras are agreed apply.

09Landlord's liability

• The landlord is liable in accordance with the statutory provisions for damage resulting from an intentional or grossly negligent breach of duty by the landlord. The statutory liability provisions apply to damage arising from injury to life, limb or health.

• The statutory provisions also apply to property brought onto the premises by the guest.

10Withdrawal by the landlord

The landlord may withdraw from the contract if the guest has intentionally provided materially false information when booking or if unforeseen circumstances beyond the landlord's control make it impossible to provide the apartment. The guest will be informed without delay. Amounts already paid for services not provided will be refunded. Further statutory rights remain unaffected.

11Final provisions

German law applies. Mandatory consumer-protection provisions remain unaffected. If any provision of these terms is wholly or partly invalid, the validity of the remaining provisions is not affected.
